• PLEASE DO NOT DRAW MY CHARACTERS WITHOUT PERMISSION! If I have given you permission in the past,go for it-If you're a friend (or close friend) feel free to draw them anytime!
• Pretty much all my OCS are 18+ and are depicted in GORE. sometimes NSFW, and often BOTH.
please keep in mind all my characters are part of fictional worlds, they may have triggered or illegal topics with them and I use these topics to cope. I am fully aware the devastating effects they have on people in real life,but I won't change my mind on how I use them in fiction.
• MY CHARACTERS ARE MY CHARACTERS ! DO NOT REFERENCE, [heavily] INSPIRE, KIN, OR ROLEPLAY WITH MY CHARACTERS ! YOU DO NOT OWN THEM,THEREFORE YOU DO NOT HAVE THE RIGHT TO USE THEM ! (THIS INCLUDES THEIR ART AS WELL!!!!)

I work with Gore, NSFW and sometimes the themes combined; These themes also have underlining "problematic" themes.
Understand that those who follow me, Support me, or otherwise are mature enough to understand the concept that Fiction doesn't Equal reality.
Bare in mind that I use these topics to cope , sometimes these topics can also be fetish.
I have warnings plastered everywhere, especially more in depth on my Toyhouse which is where I am mainly located.
General T.O.S• As a General Rule of thumb, If you are to obtain artwork from me you automatically agree to the ARTWORK USAGE portion of my T.O.S [which isn't super strict!]
• If you are to obtain a design from me, you must agree to the Design Form. This is to confirm that you have read my T.O.S and will abide by my rules; Failure to do so will be noted and consequences will follow.• PAYMENT MUST BE SENT UPFRONT, I WILL NOT WORK ON THE COMMISSION WITHOUT THE PAYMENT.
• ALL PAYMENTS MUST BE THROUGH PAYPAL; AND YOU MUST DM ME.
• DO NOT BUY FROM ME IF YOU CANNOT AFFORD MY PRICES OR MY ARTWORK AT THE TIME!
• I WILL NOT PROVIDE A REFUND! If something comes up before the artwork is complete, we can talk about a refund! But I will not provide one after the artwork has been started/finished. This also applies to chargebacks, etc.
• I WILL NOT PROVIDE AN IMAGE WITHOUT A WATERMARK! I have my watermark on my artwork for a reason - if you don’t like it, Don’t commission me! Simple. If you are to ask for a watermarkless image,I will indeed strike you.
• I WILL NOT DRAW FOR, SELL TO, ANYONE ON MY BLACKLIST!
Commission T.O.S• I have the right to decline / not accept your commission . I also serve the right to refund you and cancel your commission if I cannot follow through with it.
• My commissions depending on work load will be done same day or next day - If this is not the case you will be updated ASAP.
• I provide WIPS! please add me on discord for instant and frequent WIPs. Otherwise, there will be few and late ones through toyhouse.
• I do not edit my artwork after it is finished. I send plenty of wips [if not, after each stage
[sketch,coloring,finishing]. If you wish for something to be changed, TELL ME during that stage!
• YOU ARE NOT ALLOWED TO EDIT MY ARTWORK IN ANY SHAPE OR FORM. CONTACT ME FIRST TO EDIT IT FOR YOU!
• No charges for changes.
• Do not give me a character with an incomplete ref - If you give me a headshot ref for a headshot,thats entirely fine but do not give me a ref and tell me to add something that ISNT on the ref. I seriously hate that - you may point out things that others forget on the ref,but thats it.
• When giving me a character to draw please include a brief personality or idea for posing. You may also give me a detailed idea as well, Anything helps!
• Refs must be from Sta.sh, Toyhouse, Google drive, Discord link or Ref sheet? I will not accept from elsewhere.
• Backgrounds are 100% up to me. Sometimes with or without depending on the comm type.
Artwork Usage T.O.S
I allow people to use my COMMISSIONED artwork but I have rules regarding it !
• I’ll say this again, my artwork is watermarked. I will not remove, edit or move my watermark.
• Do NOT use/edit my personal artwork in any way shape or form. It is MY artwork.
• YOU ARE NOT ALLOWED TO EDIT MY ARTWORK IN ANY SHAPE OR FORM. PERSONAL OR YOUR COMMISSION/ART TRADE. CONTACT ME FIRST TO EDIT IT FOR YOU!
• Do not edit my commissioned artwork in any way shape or form ! That includes to crop it if there are multiple characters on one canvas, ask me to crop it! Editing my artwork makes me feel very uncomfortable ! I will flag you if you are to do this!
[Commissioned artwork means you,the commissioner.]
• You may not repost my artwork unless of course its on Toyhouse.
• You may use my artwork STRICTLY for personal use - meaning you should not use it for personal gain [money,designs,etc,etc.]
• You may use my artwork as icons on any platform, Page decor, etc as long as there is proper credit given ! If you are to use my artwork offsite, please link/Credit back!
• you may not use my artwork to make merch or anything of the sorts.
• The artwork you have commissioned is only FOR YOU TO USE! [Or the person you got it for,etc.]
Recap;1. All payments are in CAD through Paypal.
2. No refunds or chargebacks.

4. Payments must be upfront . I do not start until I receive the money.
5. I will not edit the artwork after it is finished. You must make changes during the early stages.

Meaning any designs you own from me, these are your rights while you own them.After finishing your payment for your adopt, you may do what you please with it as long as it follows my T.O.S below!♦ You may redesign, add or remove things on your character. Try to make sure you keep them recognizable !
★ If you’re not sure what is too much, feel free to dm/pm me and show me what you’re doing! If it’s unrecognizable but you showed me before hand I’ll let it slide! If this is to happen, I prefer to still keep the creator credit. Feel free to add yourself as designer, though!
Due to a past dispute, I will no longer allow someone to reupload the character or change creator credits.
★ DO NOT change species traits - colors are OK!♦ NEW RULE: If you are autho only, Please give me a key to the character you adopt from me! I'd like to see where my character is, how they're doing, etc. Failure in handing me a key to the character will result in a strike.
★ keys are personal use for me ONLY. It's just to check what you've been up to <3 If you haven't done anything its ok! you don't need to do anything right away, It's just so I know where the character is.♦ If you've been given a Gaia from me , Feel free to edit them as much as you see fit!
★ Please do not make a new character out of them and opt out of my credit for design ! You can make yourself a designer of course, That's completely okay !
(I understand that gaias have items that everyone can use,so I dont mind you changing them up!)♦ You're allowed to use your adopt however you wish, NSFW/GORE, Stories, Comics, etc.
★ I'd prefer you don't use them commercially-but as long as you include credit then that's fine.
★ It is preferred that you don't use my characters for hate art, etc, but I cannot and Will not stop you.
Bare in mind, this does NOT mean I condone / Endorse it, I just don't like restricting Creative Freedom.
★ ONLY if a species does not have it's own rules regarding this - An example is milkis, they allow no NSFW content made of the species characters, even if it's your own!♦ Please be sure to credit me the first time you draw and post them OFFSITE! Just link back to my toyhouse♦ DO NOT, REPOST MY CHARACTER ON TOYHOUSE!
★ You will be sent a Toyhouse profile with your character!♦ YOU MUST ASK ME IF YOU CAN RESELL, TRADE OR GIFT!!
★ You MUST ask me if you can resell,trade or gift your character and LET ME know who it's going to, As everyone who owns my designs MUST agree to this form.
★ You poked my form, Saw the person you're trading with has agreed to my form previously? Go ahead and trade without asking me first! I only request to know who theyre going to to make sure they have agreed and understood my T.O.S. If they have, Go right ahead!♦ No longer interested in a species - want to keep my design? Feel free to ask me if you can void!
★ As long as the species allows voiding, You're free to do so! Just double check with me first!♦ Please make sure if you really want my characters, i don't want them collecting dust.♦ I DO NOT, EVER HAND OUT UNWATERMARKED IMAGES. DONT BOTHER.【 IF I AM OWNER TO THE WORLD/SPECIES, I WILL NOT CHANGE MY CREATOR CREDIT!
★ you may of course,add yourself down as designer, but keeping me as credit makes sure that there are no OFFBRANDS, or UNOFFICAL adopts/characters going around!
This also helps as to if there's a masterlist, you don't got to spend hours on hours trying to find your character you've been offered, as long as IM down as the creator, the character is OFFICIAL.【 If you find that you want another design-feel free to ask for a custom, myo slot, etc! Im down!As a reminder, you must fill out the agreement.

Failure to fill out the forum forfeits your legitimately of my design [if received in a third party trade.]
Failure to do so when trading with me forfeits the trade/payment, etc.Failure to follow these rules will result in a strike, After three strikes you will be blacklisted.
First time offences will be striked - but with continued good behavior be removed.
Recorded strikes are private - but the offender is spoken to.
Ownership is ONLY revoked if you are blacklisted and deemed to be using the design in a malicious way - You must receive THREE STRIKES to be blacklisted.
If you are blocked [BY ME], You still keep the designs.
If you block me - you forfeit the ownership to the design.
If you are to block me shortly after agreeing to my T.O.S - Ownership is forfeited and you are blacklisted.
If you are to block me after being warned of a strike - you forfeit ownership to the design and you are blacklisted.
THIS is only in instance if you block me first - not I block you and then you block me back.Public Blacklist.
